Rights of Light: Maximizing Development Potential, minimizing risks

Often seen as a rather unique and complex field, eb7 offers simple proactive advice to guide you through the issues of Rights of Light and how to deal with them.

A right of light is an easement held by a dominant landowner over a servient landowner and is usually gained through long enjoyment (prescription), but can also be gained by Grant or Deed. It is a private legal easement which, whilst similar in its assessment, is wholly separate to the planning considerations of Daylight and Sunlight.

An important part of the process for developers is to gain an understanding of the build potential of a site with respect to neighbouring properties’ Right to Light. To this end we can produce development envelopes maximising the potential of the development site.
